    $20 Million Dollar Experiment to See if You'll Rent a Song for 10 Cents

    A music experiment will soon begin with the ambitious attempt to reinvigorate people to buying music online. For just 10 cents you'll be able to select a song to add to your Music Locker to play whenever you like. These aren't obscure or unknown Indie bands like those you'd find on Amie Street, but include nearly the entire music library of the major record labels. This upcoming service has a big backer which might just surprise you.

    Here's how the innovative site works. Over 5 million well known songs are browsable in a web layout. Songs are ranked by the number of listens they have received - similar to the strategy invented 10 years ago. Each song can played one time in its entirety with the built in flash player. Subsequent plays are limited to 30 seconds. Next to every song is an "Add" button which for a single credit will add the tune to your personal collection. Credits cost 10 cents and each new customer gets 50 credits for free.

    Once a song is added it is accessible from your "My Collection" area where it can be listened to an unlimited number of times. The songs are not downloadable so they are not useful for portable players or your mobile phone. There is also no ability to play the songs on Internet radio, game console and DVR devices (like Tivo) as you can with the Locker from MP3tunes. These 'web songs' are trapped in a tab of your browser.

    While the advertisements talk about "buying" songs it is more akin to a rental model. The songs and the permission to play them are stored on a remote machine by a company that may discontinue the service at anytime - like a landlord who can change the rules whenever they feel like it. The first time I wrote about this issue I gave the example of the Coke Music store going flat. Then the Virgin Music store ceased operation and most recently the MSN Music Store announced they would pull the plug on August 31st and all purchased songs would go into the coffin as well. If Microsoft, the richest technology company in the world, cannot keep their store going that indicates you need to expect any store to be in jeopardy of shutting down.

    The financial backers of this dime-a-song rental concept might surprise you - major record label Warner Music Group. They quietly invested $20 million into a company called Lala late last year (2007) when they devised this strategy. At that time they also agreed to put printed advertisement for Lala into 25,000,000 CDs in exchange for the right to greater ownership. (WMG also sells CDs plus digital tracks through Lala - a concept I first tried with limited success.) Lala has raised a substantial $34.7 million in investment money to date. At the time of this writing, the service is not yet public but it will be eventually at's main page.

    Will people pay ten pennies for a restricted web song with pseudo ownership? I have serious doubts. People prefer free stuff on the net and there's plenty of it. You can get full length streaming versions of U2's Pride on Napster, Imeem or even better your choice of 6 videos from YouTube for free. So what would convince someone to buy the Lala version?

    WMG and Lala's song rental is an admirable concept with a solid design and interface. And it is a positive sign to see the major labels agreeing for songs to go into a personal locker area - (albeit a highly restrictive one). But any locker needs to be open to the world via an API so the music can flow to the car, phone, portable player as well as multiple PCs like we have at MP3tunes. A successful model needs to give more to paying customers not less to compete with free and the omnipresent black market of piracy.

    You can try this dime-a-song rental concept before it is publicly launched via this "hidden URL". Let me know if you think people will pay 10 cents to rent a song in the forum.

    Sci/Tech: UK cops arrest six alleged BitTorrent music uploaders

    Surprise new arrests in OiNK investigation

    Updated. Cleveland police have today confirmed that six people have been arrested for allegedly sharing music files via the defunct BitTorrent tracker

    Five men aged between 19 and 33, and a 28-year-old woman were detained "in relation to uploading pre-release music", the force said in a statement. Three of the arrests were made on Friday 23 May, and three on Wednesday 28 May.

    All have been bailed without charge, pending further inquiries. A spokeswoman for Cleveland police was unable to provide details of which specific criminal law or laws the six are under suspicion of breaking.

    The swoop comes more than seven months after was shutdown by a widely-publicised raid at the Middlesbrough home of its adminstrator, 24-year old IT worker Alan Ellis. A coordinated move by Dutch authorities also seized the invitation-only website's servers, which were later returned wiped.

    Ellis remains on police bail under suspicion of conspiracy to defraud and infringement of copyright law. His bail has been repeatedly extended, with the next deadline set for 1 July.

    Reports of further arrests in the investigation emerged on Friday 30 May on the filesharing blog Torrentfreak. Today it cites sources saying that the majority of those arrested did not know Alan Ellis. It's claimed they have been asked to hand over details of their accounts, including passwords.

    Section 49 of the Regulation of Investigatory Powers Act can be used by police to force suspects to disclose encryption keys and passwords. Failure to comply with with a section 49 order carries a prison sentence of up to five years.

    At the time of the shutdown, investigators took over the domain, posting a warning to the site's users. It said: "A criminal investigation continues into the identities and activities of the site's users." Many BitTorrent users had believed further arrests were unlikely, however.

    Control of the domain has since returned to its owner. was reckoned by many filesharers to be the internet's most complete music source. It focused on high quality files and featured trackers for pre-release material, which drew it special attention from record industry anti-piracy investigators. ®


    The BPI, which represents record labels in the UK, sent us this statement in response to the news:

    The BPI and IFPI worked with the police in order to close down the OiNK tracker site last October. The illegal online distribution of music, particularly pre-release, is hugely damaging, and as OiNK was the biggest source for pre-releases at the time we moved to shut it down. We provided the information to assist this investigation, but this is now a police matter and we are unable to comment further at this stage.

    Set for an initial rollout in the United Kingdom, France and Germany -- with more European regions to follow in the coming months -- AOL Radio users are bound to benefit from the association with CBS-owned, which currently boasts a worldwide visiting audience of around 21 million.

    Specifically, the new AOL Radio will include various new features and engaging multimedia options for users to familiarise themselves with, including the ability to search for favourite artists through the service before then listening to a continuous stream of their music.

    “We’re enormously excited to be teaming up with AOL in Europe to power their online radio platform. We can offer a unique music discovery and listen-again service with the millions of tracks in our catalogue, allowing us to bring groundbreaking interactivity to online radio sites like AOL’s,” enthused Martin Stiksel, co-founder of “We’re pleased AOL has recognised that the unparalleled music experience we offer is the future for online radio.”

    ‘ in a Box’, ad-supported music service expands its “offsite community” strategy

    CBS continues to show signs that it understands the distributed nature of the net — and no, I’m not saying that because it’s in the process of buying ZDNet’s parent company CNET.

    Today, (which CBS purchased in May 2007) announced a major expansion to its “offsite community” strategy by partnering with a range of social networks and other online destinations to distribute the site’s ad-supported streaming radio service.

    Dubbed “ in a Box”, the service will be made available to “multiple online platforms”, including Bebo,, Break Media, CBS Television Stations, CBS Affiliates, eMusic, Frengo, Gigya, iGoogle, Live Nation, Meebo,, Netvibes, Ning, Pageflakes, Photobucket, Piczo, Six Apart, Stardoll, and, according to the press release. Although none of the partner efforts are yet to go live — since the ink has only just dried — I’m told that each ‘ in a Box’ offering will be customized and integrated into partner sites “in a bespoke manner”. In other words, ‘ in a Box’ is both a strategy and a platform (backed up by a bunch of APIs), rather than simply a one size fits all widget.

    In a written statement Martin Stiksel, co-founder, said, “This deal brings the experience to scores of sites and potentially hundreds of millions of additional users. We’ve seen over the years how our offsite community—which experiences through third-party widgets and applications—has grown massively, to more than 19 million additional users. With this new initiative we aim to take that growth to the next level by enabling new partners and their users to engage as effortlessly as possible with our unparalleled music services.”

    As CNET’s Caroline McCarthy notes, ‘ in a Box’ closely resembles CBS’ existing online video syndication effort (’CBS Audience Network’ ) which today announced Yahoo as its latest partner.

    The “In A Box” project follows a distributed model slightly similar to the one that CBS Interactive has adopted for online video with the CBS Audience Network, which makes the company’s television and other video content available on partner sites like AOL, Veoh, and now Yahoo TV.

    And in May 2007 when CBS bought the production company behind the video podcast ‘Wallstrip’, I noted over at last100 that the deal was very much a sign of intent in terms of embracing syndication (or the widgetization of the Web).

    If there is a fine line between genius and madness I am not entirely sure which side of the line Thomas Truax falls... but I am leaning heavily towards the former.

    Accompanied by an array of home-made instruments (works of art in themselves), a guitar and a loop pedal he gave the most entertaining one-man show I have ever witnessed...

    The first song introduced us to "The Hornicator".. a versatile wind and percussion instrument (an old gramophone horn, with strings, twangy things, a kazoo and other stuff attached to it)

    Next we were introduced us to "Mother Superior" - a drum machine in the truest sense, consisting of bicycle wheels, rattles, drums, cymbals and a horn (some blinking red lights adding the icing on the cake). Watching him "program" it between songs by extending spokes and hooking up little arms and levers was fascinating.

    Sci/Tech: BPI secures landmark deal in battle with illegal file-sharing

    The BPI has taken a giant leap forward in its efforts to stop illegal file-sharing on the internet by signing a landmark deal with Virgin Media.

    While currently trying to reach a voluntary agreement with ISPs over illegal file-sharing, the recording organisation has managed to persuade Virgin Media to join forces with it on a new education campaign. IIt is expected to be the first of a series of initiatives the body is working on with other ISPs.

    As part of the campaign customers whose accounts have been used to distribute illegal music will receive letters from Virgin Media and the BPI laying out practical advice on how to prevent internet account misuse, links to legitimate sites and the potential dangers – threats of viruses and spyware - of downloading files from illegal sites.

    BPI chief executive Geoff Taylor says the industry needs to partner with ISPs to stop illegal activity and “this is the first illustration of this. IIt is significant".

    Taylor concedes there is still a long way to go before the music industry and the ISP community can reach an accord on how to deal with illegal file-sharing, but this deal represents progress towards that. “Virgin Media is the first ISP to publicly address the problem. It is a socially responsible ISP and I think other ISPs will look at this and see progress,” says Taylor. “I am very encouraged they have engaged with us. They understand the rights of musicians.”

    Taylor also believes this deal could be a sign that change is in the air and says it is only through partnerships with ISPs that companies can build new commercial services and make illegal file-sharing less attractive.

    A spokesman for Virgin Media adds that Virgin’s legacy in music means it is keen to ensure its customers do the right thing. “Our goal is to educate customers and trying to be responsible. These are steps and we feel they are appropriate,” he says.

    Warner Music Group (WMG) has pulled its catalog out of's "on demand" free streaming service, which the CBS-owned service launched to great fanfare in January. Users can still hear Warner artists via the site's "radio" option, which doesn't allow you to select individual songs. But you can't order up individual songs from WMG artists. Like, say, Madonna:

    What's the issue? We don't have the details, but we assume this is a straightforward debate about money: As in, Warner wants more of it. The company has licensed its music for on-demand streaming to iMeem and the forthcoming MySpace JV; in both cases, it has ended up with equity stakes in the services.

    We're told WMG had licensed its music to on a month-to-month basis and hasn't renewed. A WMG spokesman confirmed that the company's music isn't on the service but wouldn't offer comment.'s response:

    "We are currently negotiating a new agreement with Warner Music Group and are working hard to build the most comprehensive music service on the web. While we work things out, be assured that there's more then enough music to fill a lifetime of listening on, and we are continually adding to it.".

    As far as we know, still has working arrangements with the other 3 majors: EMI, Sony BMG and Universal Music Group.

    As the first anniversary of its $280 million acquisition by CBS draws near, has unveiled a new beta version with a more powerful design and a plan to expand the social music site's current subscription option.

    The site's little-publicized music subscription service costs $3 per month. In its current iteration, the basic subscription removes ads, shows who's been cruising your profile, lets others listen to your station and allows faster access during peak usage hours. says it will continue offering this basic subscription, but that an upcoming subscription package will include unlimited access to the catalogs of all four major labels plus 150,000 indie labels and artists. As of now, users can listen to any artist/label-uploaded track up to three times for free (songs that have been heard three times will still play on the site's radio stations).

    But this beta, currently available only to current basic subscribers, is about much more than just the upcoming subscription package; it involves a full redesign, adding powerful features for playing, sharing and adding music to your library from anywhere on the site.

    "Three main concepts driving the UI and feature development for this next-generation are: play music, share music and add music," according to's Hannah Donovan. "We've focused on making these three things easier for everyone to enjoy, even your mum."

    To those ends, the site has added a new player at the top of every page that lets you play whatever music is listed there, so there will be "hopefully no more digging around for play buttons and radio stations," Donovan said. Every music page has also been set up to encourage sharing with friends or adding songs to your library. You can also browse your friends' libraries and add tracks from there.

    In addition, the beta lets users manually add songs and artists to their libraries in addition to having them added automatically, or "scrobbled," via iTunes or their preferred media player. This will let you expand your music collection purely through, rather than acquiring the music elsewhere and scrobbling it into your library.

    Extras include an activity feed that let you see what all your friends have been listening to, real-time music popularity charts and podcasts.

    If you subscribe to, you can enter the beta now. Once the team finishes responding to beta testers' feedback, they'll make these features available to a wider swath of users (how refreshing -- a beta that's actually a beta, as opposed to an initial release, which is how other companies have been using the term).

    EMI deal unlocks BBC archives

    LONDON (Billboard) - The BBC has handed EMI Music the keys to its treasure-filled broadcast vault.

    Through an agreement struck between EMI and BBC Worldwide, the commercial arm of the broadcaster, the two parties will be able to tap into one each other's content wells.

    The London-based music group will have access to the BBC's archive of TV and radio recordings to create products for release across multiple platforms, including DVDs, CDs and digital downloads.

    BBC's archive includes such EMI spoils as 1967 live radio performances by Pink Floyd, playing tracks from its debut album, "The Piper at the Gates of Dawn," plus a 1975 documentary on David Bowie and early recordings of Coldplay.

    On the flip side, BBC Worldwide will be able to use EMI artist performances to create new programming for commercial use, including international radio and TV programs. BBC Worldwide has also obtained rights to distribute the content directly to consumers by way of its planned digital services.

    It's not the first time the BBC has encouraged the major-label community to tap into its broadcast library. Universal Music struck a landmark licensing deal in mid-2005, enabling the market leader to leverage the BBC's audio and visual content for use in a broad range of internationally available products.

    Albums and singles head in opposite directions

    In a week of contrasting fortunes, singles sales slide to a 2008 low, while album sales rocket to their highest level of the year.

    Helped by new releases by Coldplay and The Fratellis and the approach of Father’s Day, album sales increased for the fifth week in a row, growing a massive 35.6% to 2,810,459.

    It’s the first time that sales in the Father’s Day lead-up have topped same year Mother’s Day and Easter sales tallies. They are 2.45% above same week 2007 sales of 2,743,188, when The Traveling Wilburys’ Collection topped the Father’s Day hitlist with sales of 110,130.

    Not released until Thursday, Coldplay’s eagerly-awaited third album Viva La Vida Or Death And All His Friends scorched to number one with 72-hour sales of 302,074, cornering a 10.75% share of the market.

    That total – the highest since Leona Lewis’s Spirit opened with sales of 375,872 last November - includes 420 copies on vinyl and 30,378 downloads, a new weekly record for downloads, almost trebling the previous mark.

    In fact, helped by some competitive pricing (Woolworth’s, notably, offered 5,000 downloads at £4.97 apiece) first-day download sales alone beat the previous record for a whole week for any other album.

    The only other albums to sell more than 10,000 copies on download in a week are Leona Lewis’s Spirit (11,296) and Duffy’s Rockferry (11,399), which topped the tally on their first week of sales, 30 and 14 weeks ago, respectively.

    With just three days sales behind it, Viva La Vida is already number 25 in the all-time digital sales chart, where leader Amy Winehouse’s Back To Black has sold 113,578 copies across two editions.

    Coldplay’s three studio albums prior to Viva La Vida have all sold upwards of 2m, making them the first group to achieve such a hat trick. Parachutes, which opened with sales of 70,935 in 2000, has thus far sold 2,399,932 copies; 2002’s A Rush Of Blood To The Head opened with sales of 273,924, and is now at 2,653,165; and X&Y moved 464,471 copies when opening its account in 2005, a total since increased to 2,492,466.

    A Rush Of Blood To The Head ranks seventh, X&Y ninth and Parachutes 12th in the list of the best-selling albums of the 21st century. All three are in the Top 75 at present, X&Y at 50 (4,759 sales last week), Parachutes at 61 (3,991 sales) and A Rush Of Blood To The Head at 64 (3,688 sales). Giving the band a grand total of five albums on the list their recently reissued Live 2003 CD/DVD set climbs 60-46 on sales of 5,164.


    Despite the fact that all of its tracks, apart from Yes, have been made available for download separately, Coldplay’s new album’s component parts do not make a mass invasion of the singles chart, with the already-charting Violet Hill (up 14-12 on sales of 10,434) joined in the Top 75 only by Lost (new at number 62 on sales of 1,974) – although the chart-ineligible Viva La Vida sold 18,868 copies, enough for a number four chart placing.

    As memories of Britain’s Got Talent winner George Sampson’s breakdance performance to Mint Royale’s Singin’ In The Rain fade, so do sales of the track.

    Although the song remains at number one for a second week, they fall by 40.1% week-on-week to 27,537 – the lowest tally for a number one single since Sean Kingston’s Beautiful Girls sold 26,248 copies on its last week at number one, some 38 weeks ago.

    Although Rihanna’s Take A Bow remains at number two, its sales also slide, to 20,755.

    The only singles in the Top 10 to post sales gains are Ne-Yo’s Closer (up 7.5% to 19,124); Sara Bareilles’ Love Song (up 2.1% at 17,563); and Gabriella Cilmi’s Sweet About Me (up 4.8% at 16,504).

    Coldplay: how to top the charts by mistake

    Neil McCormick on what the record industry can learn from some unexpected successes


    How do you have a hit without releasing a single?

    Coldplay's stirring anthem Viva La Vida is number one on both sides of the Atlantic, making them the first British group to achieve this feat since the Spice Girls in 1997. This would be remarkable enough in itself, but, in a sign that the music business is undergoing top-to-tail transformation, they have done it by accident.

    Coldplay's current single is officially Violet Hill, which, to complicate matters further, they gave away free. It was downloaded more than two million times (enough to have outsold the combined top 40 in the US and UK).

    Meanwhile, the title track of their album, Viva La Vida, was made available through iTunes as a (non-chart eligible) taster, with a 30-second video advert. When the album was officially released last week, so many people downloaded that track that it became Coldplay's biggest ever hit.

    Viva La Vida is still listed as "coming soon". A big-budget video epic by director Anton Corbijn is in the works, but one wonders whether there is any point in finishing it, since, by the time it hits screens, fans may have already moved on to their next self-determined favourite.

    The irony is that Coldplay were one of those groups who seemed doomed never to have a number-one single. It may be regarded as the pinnacle of popular success, but many revered bands failed to reach that peak, including the Smiths, the Happy Mondays, Pulp, Radiohead and even those hardy perennials of hair-dryer rock, Bon Jovi.

    Coldplay came closer than most, twice reaching number two, but In My Place got stuck behind Pop Idol reject Darius in 2002, while three years later Speed of Sound suffered the indignity of being beaten by Crazy Frog. An infuriated Chris Martin commented "that little thing should have its legs chopped off. I'd like to eat them in a restaurant."

    Talking up their new album, Martin declared: "We have to have one song that we feel everybody has to hear before we die, otherwise we'll be terribly depressed." It appears the public chose the song themselves, using the new powers conferred on them by digital distribution. The music business may yet have cause to believe in life after the internet.
