If you want to use your last.fm radio stations through the app then you need to be in range of Wifi. You also need to be a subscriber so you need to pay the $3 a month.

If you just want to scrobble the songs that you have put onto your mp3 player yourself, you just need to have the last.fm app installed and then listen to your music as normal through the mp3 player. No need for wifi. The app will keep track of what you listen to and then submit those details to the website the next time you're in range of wifi.

Last.fm is indeed a 100% legal service. The subscription is $3 a month.

Many of the answers to the question you are asking can be found in the official Last.fm FAQ.
